Agreement to these terms.
By accessing our site, creating an account, or placing an order, you confirm that you have read these Terms and our Privacy Policy, and that you agree to be bound by them. These Terms form a binding legal agreement between you and HushedMind, Inc.
If you are entering into these Terms on behalf of a company or other legal entity, you confirm you have the authority to bind that entity.
Who we are.
HushedMind, Inc. is a Delaware-registered US company that designs and sells the HushedMind breathing trainer for adults with white coat syndrome. Our store runs on Shopify.

Eligibility.
You must be at least 18 years old and legally capable of entering into a binding contract to use our site or buy our products. By placing an order, you confirm that you meet these requirements.
HushedMind is designed for adults. We do not knowingly sell to minors. If you are under 18, you may only use the site under the supervision of a parent or legal guardian who agrees to these Terms on your behalf.
Account responsibilities.
You don't need an account to place an order, but if you create one, you are responsible for:
- Providing accurate, current information (name, email, shipping address).
- Keeping your password confidential and not sharing it with anyone.
- All activity that happens under your account, whether or not you authorized it.
- Notifying us promptly at contact@hushedmind.com if you suspect unauthorized access.
We may suspend or terminate accounts that violate these Terms, contain false information, or are used for fraud.
Orders, pricing & payment.
Order acceptance
Your order is an offer to buy — it becomes binding only when we accept it by sending an order confirmation. We may refuse or cancel any order at our discretion, including for suspected fraud, pricing errors, or products listed in error.
Pricing & errors
All prices are in US dollars (USD) unless otherwise stated and exclude applicable taxes and shipping (where charged). We make every effort to display correct prices, but errors happen. If a product is listed at an incorrect price, we may cancel the order and refund any amount paid before shipment.
Payment
We accept payment through Shopify Payments, Stripe, PayPal, and other processors shown at checkout. By submitting an order, you authorize us (and our payment processor) to charge the total amount, including any taxes, to your selected payment method.
Taxes
You are responsible for any sales tax, VAT, or other taxes applicable to your order based on your shipping destination. Where required, these will be calculated and shown at checkout or collected by the carrier on delivery.
Shipping & delivery.
Processing & shipping times
- Free shipping on every order.
- Orders ship within 24 hours of being placed (business days only).
- Delivery time: typically 6–11 business days to all destinations (US and international).
Delivery estimates are not guarantees. Carrier delays, weather events, customs holds, and force majeure events are outside our control.
International orders, customs & duties
International customers are responsible for any import duties, customs fees, taxes, or other charges imposed by their country of destination. These charges are collected by the carrier or local customs authority on delivery and are not included in our prices.
If you refuse delivery or fail to pay customs charges and the package is returned to us, we will refund the product cost minus any return-shipping fees we incur.
Risk of loss
Risk of loss and title for products passes to you when the carrier hands the product over to you (or to the address you provided). If a package is lost or damaged in transit, contact us immediately at contact@hushedmind.com and we'll work with the carrier to resolve it.
Wrong address
You are responsible for providing an accurate shipping address. We are not responsible for orders shipped to addresses you entered incorrectly. If a package is returned because of a wrong address, we'll refund the order minus return-shipping costs.
Returns & 60-day guarantee.
Our promise
We stand behind HushedMind with a 60-day money-back guarantee. If you're not satisfied for any reason, you may return the product within 60 days of delivery. How the return is handled depends on whether the product is defective or simply unwanted.
If your product is defective or damaged
If your HushedMind arrives damaged, defective, or stops working through no fault of your own within the 60-day window, we'll make it right:
- Email us at contact@hushedmind.com with your order number and a short description (photos help).
- We'll offer your choice of a free replacement or a full refund, including any return-shipping costs.
- You will not pay anything to send the defective unit back.
If you simply want to return a non-defective product
If you change your mind or the product isn't right for you (and there's nothing wrong with it), you can still return it within 60 days — but you cover the return shipping:
- Email us at contact@hushedmind.com with your order number to request a return.
- We'll send you instructions and the return address.
- Ship the product back at your expense. For hygienic reasons, the device must be in its original packaging with all accessories included. We recommend a tracked shipping service — we are not responsible for returns lost in transit.
- Once we receive and inspect the product, we'll process your refund within 5–10 business days to your original payment method.
What's not covered
- Returns requested more than 60 days after delivery.
- Products damaged through misuse, modification, or normal wear after extended use.
- Products returned without their original packaging or with missing accessories.
- Customs duties or import fees you previously paid to your local authority — these are not refundable by us.
Wellness device disclaimer.
HushedMind is a wellness device, not a medical device. It is not intended to diagnose, treat, cure, or prevent any disease or medical condition, including hypertension or white coat syndrome. It is not FDA-approved as a medical diagnostic or therapeutic device, and statements about its use have not been evaluated by the FDA.
You should not use HushedMind to replace medical care
Always consult a qualified healthcare provider for any medical condition. HushedMind is designed to support a calm, regulated nervous system through breathing practice — it is not a substitute for prescribed medication, physician advice, or emergency care.
Do not use HushedMind if
- You have severe untreated cardiovascular disease, recent heart surgery, or active arrhythmia, without first consulting your doctor.
- You have a respiratory condition that makes resistance breathing unsafe (severe COPD, recent pneumothorax, etc.).
- You are pregnant and have not been cleared by your physician for breath-training exercises.
- You experience dizziness, chest pain, fainting, or other adverse effects during use — stop immediately and seek medical attention.
Individual results vary
Customer experiences shared on our site reflect individual users. They are not typical, guaranteed, or representative of every user. Your results may differ.
Emergency
If you are experiencing a medical emergency, call 911 (in the US) or your local emergency services immediately. Do not rely on HushedMind, our website, or our customer service for emergency medical advice.
Acceptable use.
When using our site or products, you agree not to:
- Misuse the 60-day guarantee (e.g., serial returns, fraudulent claims, returns of products that were not purchased from us).
- Resell, redistribute, or commercially exploit HushedMind products without our written permission.
- Scrape, copy, or reproduce our website, content, photos, or product descriptions for use elsewhere.
- Hack, probe, or disrupt our site, servers, or any connected systems.
- Use the site for any unlawful purpose or in violation of any applicable law.
- Impersonate HushedMind, our team, or another customer.
- Submit false reviews, fake testimonials, or misleading content about our products.
We may suspend access, cancel orders, block accounts, or take legal action against anyone who violates these rules.
Intellectual property.
All content on this website — including the HushedMind name, logo, designs, product photos, illustrations, copy, videos, and overall visual identity — is owned by HushedMind, Inc. or our licensors. It is protected by copyright, trademark, and other intellectual property laws.
You may not copy, modify, reproduce, distribute, or create derivative works from any of our content without our prior written permission. Personal, non-commercial use (such as viewing the site or sharing a link to a product page) is allowed.
Your content (reviews, photos).
If you submit a product review, photo, video, social media post, or any other content about HushedMind ("Your Content"), you grant us a worldwide, perpetual, royalty-free, non-exclusive license to use, reproduce, display, adapt, and distribute Your Content for marketing, product pages, social media, and similar purposes.
You confirm that:
- Your Content is your own original work, or you have permission from anyone shown in it.
- Your Content is truthful and reflects your actual experience.
- Your Content does not violate any law or third-party right.
We may remove any content at our discretion. If you'd like a piece of Your Content removed, email us at contact@hushedmind.com.
Disclaimers & limitation of liability.
"As is" basis
Our site and products are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, except as expressly required by applicable consumer-protection law. We do not warrant that the site will be uninterrupted, error-free, secure, or free of viruses.
No medical warranties
We make no representation or warranty that HushedMind will produce any specific health, blood pressure, or wellness outcome. See Section 08 for our full wellness device disclaimer.
Limitation of liability
To the maximum extent permitted by law, HushedMind, Inc., its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profit, data, or goodwill — arising from your use of our site or products, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim related to these Terms, our site, or our products is limited to the amount you paid us in the 12 months before the claim arose, or USD $100, whichever is greater.
Some jurisdictions don't allow the exclusion or limitation of certain damages or implied warranties, so some of the above may not apply to you. You may have additional rights under the consumer-protection laws of your country or state.
Indemnification.
You agree to indemnify, defend, and hold harmless HushedMind, Inc., its officers, directors, employees, and partners from any claim, loss, damage, liability, or expense (including reasonable attorneys' fees) arising from:
- Your violation of these Terms.
- Your misuse of our products or our website.
- Your infringement of any third-party right, including intellectual property or privacy rights.
- Any false or misleading content you submit to or through our site.
Governing law, disputes & contact.
Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Informal resolution first
Before filing any formal claim, you agree to first contact us at contact@hushedmind.com and try to resolve the dispute informally. Most issues can be resolved this way within 30 days.
Binding arbitration
If informal resolution fails, any dispute arising out of or related to these Terms or our products will be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, in English, in Wilmington, Delaware (or remotely, where permitted). Judgment on the award may be entered in any court of competent jurisdiction.
Class-action waiver
You and HushedMind agree that any dispute will be resolved on an individual basis only. You may not bring a claim as a plaintiff or class member in any class, collective, or representative action.
Exceptions
The arbitration requirement does not apply to: (a) small-claims court actions, where eligible; (b) requests for injunctive relief to protect intellectual property; or (c) where prohibited by applicable consumer-protection law.
Changes to these Terms
We may update these Terms from time to time. The "Effective" date at the top of this page shows when they were last changed. If we make material changes, we will notify you by email (if you have an account) or by posting a notice on our website. Continued use after changes take effect means you accept the updated Terms.
Severability & entire agreement
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force. These Terms, together with our Privacy Policy, constitute the entire agreement between you and HushedMind regarding your use of our site and products.
